The State has withdrawn defiance case against opposition Forum for Democratic Change (FDC’s) Dr. Kiiza Besigye that was being heard at Kasangati Magistrate’s Court for loss of interest in the matter.

The Magistrate Fred Egesa said he had no choice but to discharge the case after he was presented with the Director of Public Prosecutions withdrawal letter.

Besigye’s lead counsel Ernest Kalibala has however challenged the state withdrawal saying the matter was already at an advanced stage.

The former FDC presidential candidate who is currently detained at Luzira prison for treason charges was produced at the Kasangati court this morning for hearing of the disobedience case amid tight security.

Dr.Besigye was facing charges of disobeying lawful orders and participating in an unlawful procession on April 5th this year.

Prosecution alleges that Dr.Besigye while on his way to the party headquarters in Najjanankumbi for Black Tuesday Prayers refused to heed to orders issued by police at Mulago round about when he declined to follow traffic guidelines.

The prayers were part of a wider defiance campaign in protest of the February presidential election results which the FDC insists were won by its candidate and president Museveni.

Prosecution was today expected to produce its fourth and last witness in the matter.
