{"id":74052,"date":"2024-04-03T16:48:07","date_gmt":"2024-04-03T13:48:07","guid":{"rendered":"https:\/\/www.kfm.co.ug\/?p=74052"},"modified":"2024-04-03T16:48:07","modified_gmt":"2024-04-03T13:48:07","slug":"court-upholds-anti-gay-law","status":"publish","type":"post","link":"https:\/\/www.kfm.dembefm.ug\/staging_h\/court-upholds-anti-gay-law\/","title":{"rendered":"Court upholds Anti-gay law"},"content":{"rendered":"<p>The Constitutional Court has dismissed a consolidated petition challenging the Anti-Homosexuality Act 2023.<\/p>\n<p>Five justices of the Constitutional Court led by Deputy Chief Justice Richard Buteera have ruled that the Anti-Homosexuality Act was enacted to\u00a0 protect children and vulnerable members of the society.<\/p>\n<p>&#8220;We think that the\u00a0section that prohibits gay people from accessing\u00a0housing and medical care will subject them to mental health care,&#8221; Justice Buteera ruled.<\/p>\n<p>The Court had however ruled that sections 3, 2(c)\u00a0 and 9,11(2)\u00a0 are in violation of their right to health and adequate standards of living enshrined in the constitutuon and ordered that they\u00a0be struck out.<\/p>\n<p>The\u00a0 petition had sought\u00a0 among otherthings\u00a0to strike out from the Constitution a law that criminalises what they\u00a0called &#8220;consensual sex among adults&#8221;.<\/p>\n<p>The petitioners including\u00a0West Budama MP Fox Odoi, Uganda&#8217;s Ambassador to South Africa Kintu Nyango, Veteran Journalist Andrew Mwenda, Makerere University Law\u00a0professors; Sylvia Tamale, Businye Kabumba and several society orgainstaions.<\/p>\n<p>The petitioners had further alleged that the Anti-Homosexuality law infringes on several articles of the Constitution that relate to personal freedoms and dignity as well as hampering the fight against HIV\/AIDS.<\/p>\n<p>However, court ruled that the government of Uganda has been fighting the spread of HIV\/AIDS and had registered massive success and that the law will not affect its spread in any way.<\/p>\n<p>Speaking to the media after the judgement, Andrew Mwenda said they will challenge the said judgement in the Supreme Court.<\/p>\n<p>&#8220;We are going to the Supreme Court and I have full confidence that the Judges will stand above our cultural prejudices and protect rights of homosexuals to live their lives as they wish,&#8221; said Mwenda.<\/p>\n<p>According to Mwenda, grounds like protecting the children from being recruited as gay are\u00a0baseless, saying the state never provided any evidence to prove that such activities were happening in schools.<\/p>\n<p>The court has however ordered each party to bear its own costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Constitutional Court has dismissed a consolidated petition challenging the Anti-Homosexuality Act 2023.
