{"id":72819,"date":"2024-02-08T10:31:35","date_gmt":"2024-02-08T07:31:35","guid":{"rendered":"https:\/\/www.kfm.co.ug\/?p=72819"},"modified":"2024-02-08T10:48:53","modified_gmt":"2024-02-08T07:48:53","slug":"court-halts-cases-against-minister-kitutu","status":"publish","type":"post","link":"https:\/\/www.kfm.dembefm.ug\/staging_h\/court-halts-cases-against-minister-kitutu\/","title":{"rendered":"Court halts cases against Minister Kitutu"},"content":{"rendered":"<p><strong>By Juliet Kigongo<\/strong><\/p>\n<p><span dir=\"ltr\" role=\"presentation\">The Anti-Corruption Divi<\/span><span dir=\"ltr\" role=\"presentation\">sion of the High Court has temporarily <\/span><span dir=\"ltr\" role=\"presentation\">stopped the hearing of the corruption <\/span><span dir=\"ltr\" role=\"presentation\">charges against Karamoja Affairs min<\/span><span dir=\"ltr\" role=\"presentation\">ister Mary Goretti Kitutu.<\/span><\/p>\n<p><span dir=\"ltr\" role=\"presentation\">On November 28, 2023, Justice Jane <\/span><span dir=\"ltr\" role=\"presentation\">Kajuga dismissed Dr Kitutu\u2019s applica<\/span><span dir=\"ltr\" role=\"presentation\">tion in which she wanted her trial halt<\/span><span dir=\"ltr\" role=\"presentation\">ed on grounds that she was tortured by <\/span><span dir=\"ltr\" role=\"presentation\">police during arrest and interrogation. <\/span><span dir=\"ltr\" role=\"presentation\">Yesterday, the judge held that it is not <\/span><span dir=\"ltr\" role=\"presentation\">in contention that Dr Kitutu had filed <\/span><span dir=\"ltr\" role=\"presentation\">an application in the Court of Appeal <\/span><span dir=\"ltr\" role=\"presentation\">as a notice was attached to the affidavit <\/span><span dir=\"ltr\" role=\"presentation\">in support of the application together <\/span><span dir=\"ltr\" role=\"presentation\">with a memorandum and the grounds <\/span><span dir=\"ltr\" role=\"presentation\">of appeal.<\/span><\/p>\n<p><span dir=\"ltr\" role=\"presentation\">\u201cI am unable to conclude that the ap<\/span><span dir=\"ltr\" role=\"presentation\">peal is vexatious (causing or tending to <\/span><span dir=\"ltr\" role=\"presentation\">cause annoyance, frustration, or worry), <\/span><span dir=\"ltr\" role=\"presentation\">lacks a legal basis or merit and is filed in <\/span><span dir=\"ltr\" role=\"presentation\">bad faith, even though the application <\/span><span dir=\"ltr\" role=\"presentation\">before me failed. I am only required to be satisfied that the points are arguable,\u201dJustice Kajuga said.<\/span><\/p>\n<p><span dir=\"ltr\" role=\"presentation\">The judge also reasoned that it is in the spirit of the Human Rights (Enforcement) Act, 2019 that any allegaions of violation of fundamental rights and freedoms that arise during criminal proceedings, especially non-derogable\u00a0(whether the right may be infringed in certain circumstances) rights specified in Article 44 of the Constitution, that the question must first be settled before the trial resumes.
