Justice and Constitution-<\/span>al Affairs Minister Norbert Mao has <\/span>said the 48-hour constitutional rule <\/span>in which to take a suspect to court or <\/span>be released on bond should be main<\/span>tained.<\/span><\/p>\n

Minister Mao argued that personal <\/span>liberties are very important and that <\/span>it is not correct to amend the law and <\/span>extend the 48-hour holding period for <\/span>suspects.<\/span><\/p>\n

\u201c…If you assess that the evidence is <\/span>not enough on the file, then release the <\/span>person to go home, after all, the State <\/span>has a very long arm,\u201dhe said while offi<\/span>ciating at the 28th joint Government of <\/span>Uganda-Development Partners Access <\/span>to Justice (JLOS) report launch on Fri<\/span>day in Kampala.\u00a0<\/span><\/p>\n

He added:\u201cIt can even collect you (the <\/span>suspect) after releasing you. The State <\/span>is so powerful,it can get you any time if <\/span>it wants anyway.\u201d<\/span><\/p>\n

The caution by the minister comes <\/span>amid calls in prosecution and security <\/span>circles to have the 48-hour rule amend- <\/span>ed upwards. <\/span>Their core argument is that the peri<\/span>od is too short to gather sufficient ev<\/span>idence against a suspect, especially <\/span>those facing capital offences, and se<\/span>cure a conviction in court.<\/span><\/p>\n

While speaking at the East Africa As<\/span>sociation of Prosecutors (EAAP) meet<\/span>ing early this year, Director of Public <\/span>Prosecutions (DPP) Jane Frances Abo<\/span>do reasoned that the 48-hour rule was <\/span>introduced in the Constitution in 1995, <\/span>about 28 years ago, and that crime has <\/span>since evolved.<\/span><\/p>\n
