President Museveni has turned <\/span>down a request by Supreme <\/span>Court judge Esther Kitimbo <\/span>Kisaakye to retire early.<\/span><\/p>\n


The judge\u2019s application to leave near<\/span>ly seven years ahead of schedule had <\/span>been lodged three months ago in mid-<\/span>July.<\/span><\/p>\n

It was filed against the backdrop of a <\/span>reportedly difficult time on the bench <\/span>for her in recent years. Those tensions <\/span>are suspected to have exploded in the <\/span>current storm of controversy she finds <\/span>herself in, involving Chief Justice Al<\/span>fonse Chigamoi Owiny-Dollo and other <\/span>top Judiciary officials.<\/span><\/p>\n

In his October 2 letter rejecting Jus- <\/span>tice Kisaakye\u2019s request, the President <\/span>reasons that she is still the subject of an <\/span>ongoing inquiry and so cannot leave <\/span>just yet.<\/span><\/p>\n

The inquiry being conducted by the <\/span>Judicial Service Commission (JSC) is <\/span>looking into comments the judge al- <\/span>legedly made about Chief Justice Ow<\/span>iny-Dollo at the tail end of a 2021 pres<\/span>idential poll petition hearing at the Su<\/span>preme Court.<\/span><\/p>\n

\u201cI have received your letter of the <\/span>18th of July, 2023, tendering in your ear<\/span>ly retirement. As per the law, I cannot <\/span>obstruct your wishes.However,that will <\/span>pre-empt the work of the Judicial Com<\/span>mission of Inquiry or the Tribunal,\u201d <\/span>President Museveni wrote.<\/span><\/p>\n

The President observed further that, <\/span>\u201cApparently, you made some strong <\/span>statements against the Chief Justice. <\/span>Either those statements were right or <\/span>were wrong. It is the Tribunal that can <\/span>conclude that. It is thereafter that the <\/span>way forward will be clear for you.\u201d<\/span><\/p>\n

On July 18 this year, Justice Kisaakye <\/span>wrote to President Museveni in his ca<\/span>pacity as the appointing authority, ask<\/span>ing to be allowed to retire early from ju<\/span>dicial service. The thrust of her petition <\/span>was that the Constitution allows her <\/span>to leave since she is now more than 60 <\/span>years of age.<\/span><\/p>\n

By law, Uganda\u2019s Supreme Court judg<\/span>es must retire upon clocking 70 years, <\/span>but can also voluntarily step down ten <\/span>years before due date. Justice Kisaakye <\/span>was 63 when she asked to leave.\u00a0<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"
