{"id":70546,"date":"2023-11-13T09:25:26","date_gmt":"2023-11-13T06:25:26","guid":{"rendered":"https:\/\/www.kfm.co.ug\/?p=70546"},"modified":"2023-11-13T09:25:26","modified_gmt":"2023-11-13T06:25:26","slug":"govt-sued-over-plan-to-monopolise-oil-imports","status":"publish","type":"post","link":"https:\/\/www.kfm.dembefm.ug\/staging_h\/govt-sued-over-plan-to-monopolise-oil-imports\/","title":{"rendered":"Govt sued over plan to monopolise oil imports"},"content":{"rendered":"<p><strong>By Precious Delilah<\/strong><\/p>\n<p><span dir=\"ltr\" role=\"presentation\">Lawyer Hassan Male Mabirizi has <\/span><span dir=\"ltr\" role=\"presentation\">sued the government over its bid to <\/span><span dir=\"ltr\" role=\"presentation\">monopolise the importation of fuel <\/span><span dir=\"ltr\" role=\"presentation\">into the country.<\/span><\/p>\n<p><span dir=\"ltr\" role=\"presentation\">Mr Mabirizi, in his lawsuit filed before <\/span><span dir=\"ltr\" role=\"presentation\">the Anti-Corruption Court, contends <\/span><span dir=\"ltr\" role=\"presentation\">that the government\u2019s move to contract <\/span><span dir=\"ltr\" role=\"presentation\">Vitol Company as a sole importer of fu<\/span><span dir=\"ltr\" role=\"presentation\">el without going through proper bid<\/span><span dir=\"ltr\" role=\"presentation\">ding amounts to corruption and unfair<\/span><span dir=\"ltr\" role=\"presentation\">ly edges out those suppliers with capaci<\/span><span dir=\"ltr\" role=\"presentation\">ty to do so.<\/span><\/p>\n<p><span dir=\"ltr\" role=\"presentation\">\u201cThe government of Uganda an<\/span><span dir=\"ltr\" role=\"presentation\">nounced that it has created a fuel im<\/span><span dir=\"ltr\" role=\"presentation\">port monopoly through a contract with <\/span><span dir=\"ltr\" role=\"presentation\">Vitol Company. The said company did <\/span><span dir=\"ltr\" role=\"presentation\">not go through the normal bidding proc<\/span><span dir=\"ltr\" role=\"presentation\">ess under the laws of Uganda, hence cor<\/span><span dir=\"ltr\" role=\"presentation\">ruption,\u201d Mr Mabirizi avers in his court <\/span><span dir=\"ltr\" role=\"presentation\">documents filed on November 10.<\/span><\/p>\n<p><span dir=\"ltr\" role=\"presentation\">Further, Mr Mabirizi contends that the <\/span><span dir=\"ltr\" role=\"presentation\">conceptualisation, processing, selection, <\/span><span dir=\"ltr\" role=\"presentation\">contracting and grant of fuel import mo<\/span><span dir=\"ltr\" role=\"presentation\">nopoly to Vitol Company infringes on <\/span><span dir=\"ltr\" role=\"presentation\">importation rights.<\/span><\/p>\n<p><span dir=\"ltr\" role=\"presentation\">\u201cCreating a monopoly in importation <\/span><span dir=\"ltr\" role=\"presentation\">of fuel derogates economic rights of oth<\/span><span dir=\"ltr\" role=\"presentation\">er Ugandans who may have capacity to <\/span><span dir=\"ltr\" role=\"presentation\">import fuel,\u201dhe says.<\/span><\/p>\n<p><span dir=\"ltr\" role=\"presentation\">On November 1, Energy minister Ruth <\/span><span dir=\"ltr\" role=\"presentation\">Nankbirwa tabled before Parliament an <\/span><span dir=\"ltr\" role=\"presentation\">Amendment Bill to regulate the impor<\/span><span dir=\"ltr\" role=\"presentation\">tation of petroleum products.<\/span><\/p>\n<p><span dir=\"ltr\" role=\"presentation\">The Petroleum Supply (Amendment) <\/span><span dir=\"ltr\" role=\"presentation\">Bill, 2023, if passed into law in its current <\/span><span dir=\"ltr\" role=\"presentation\">form, will grant the Uganda National Oil Company (Unoc), the monopoly to supply imported petroleum products to local suppliers.<\/span><\/p>\n<p><span dir=\"ltr\" role=\"presentation\">The proposed law aims at giving exclusivity importation rights to Unoc, which monopoly is to be handed over to a Bah- rain EC-based Company, Vitol, for five years.<\/span><\/p>\n<p><span dir=\"ltr\" role=\"presentation\">The line minister explained that currently, there are multiple agencies along the oil supply chain, the reason why there are supply disruptions leading to soaring fuel prices, with a litre of petrol now going for close to Shs7,000 at a pump.<\/span><\/p>\n<p><span dir=\"ltr\" role=\"presentation\">The government also defended the exclusiveness of Vitol Company for their ability to provide finances to purchase the refineries.<\/span><\/p>\n<p><span dir=\"ltr\" role=\"presentation\">Last week, concerned fuel suppliers while appearing before Parliament, opposed the government\u2019s bid to ring fence the petroleum importation by Unoc through Vitol, arguing that bringing on board more players would lead to cheaper fuel pump prices.<\/span><\/p>\n<p><span dir=\"ltr\" role=\"presentation\">Mr Mabirizi in his law suit wants court to issue a permanent injunction, restraining government or any other state agency from enforcing the fuel import monopoly contract granted to Vitol.<\/span><\/p>\n<p><span dir=\"ltr\" role=\"presentation\">He also wants court to issue an order, nullifying the fuel import monopoly granted to Vitol Company. \u201cIt\u2019s fair,equitable and in the interest of protecting fundamental and other human rights as well as the rule of law in Uganda that this application is allowed,\u201d Mr Mabirizi says.<\/span><\/p>\n<p><span dir=\"ltr\" role=\"presentation\">By press time last Friday, the court had not yet summoned the Attorney General, the sole respondent in this case, to file his defence before a hearing date could be fixed.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>By Precious Delilah Lawyer Hassan Male Mabirizi has sued the government over its bid to monopolise the importation of fuel into the country.
