{"id":45732,"date":"2021-03-09T08:46:34","date_gmt":"2021-03-09T05:46:34","guid":{"rendered":"https:\/\/www.kfm.co.ug\/?p=45732"},"modified":"2021-03-09T08:46:34","modified_gmt":"2021-03-09T05:46:34","slug":"court-dismisses-case-against-govt-oil-agreement-with-bidco","status":"publish","type":"post","link":"https:\/\/www.kfm.dembefm.ug\/staging_h\/court-dismisses-case-against-govt-oil-agreement-with-bidco\/","title":{"rendered":"Court dismisses case against govt oil agreement with Bidco"},"content":{"rendered":"<div dir=\"auto\">\n<div dir=\"auto\"><b>By Ruth Anderah\u00a0<\/b><\/div>\n<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">The Constitutional Court has dismissed a petition that was filed 15 years ago challenging the agreement entered between the government of Uganda\u00a0 and BIDCO Oil Refineries Limited for the development of the Oil Palm Industry in the country.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">A panel of five Constitutional Court Justices led by Kenneth Kakuru have unanimously dismissed the petition filed by former Kyadondo South MP Issa Kikungwe who passed on in 2017 and Lubaga South MP John Ken Lukyamuzi.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">The petition was dismissed on ground that it lacked merit and that there was nothing constitutional for Court to interpret.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Kikungwe and Lukyamuzi filed the case in 2006 challenging a decision to grant BIDCO Oil Refineries Limited a superior status over other oil producers.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Their petition followed the\u00a0 4th April 2003 agreement entered between\u00a0 government\u00a0 and BIDCO to process palm oil in Kalangala District.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">The petitioners argued that\u00a0 \u00a0BIDCO was exempted from import and stamp duty taxes and value added tax for a period of 25 years which decision they said was discriminatory and unconstitutional.<\/div>\n","protected":false},"excerpt":{"rendered":"<p>By Ruth Anderah\u00a0 The Constitutional Court has dismissed a petition that was filed 15 years ago challenging the agreement entered between the government of Uganda\u00a0 and BIDCO Oil Refineries Limited for the development of the Oil Palm Industry in the country.
