The Attorney General has defended government\u2019s\u00a0position before the Constitution Court\u00a0to spend over 64bn shillings on purchase of cars for MPs.<\/p>\n
Senior State Attorney\u00a0Gorret Arinaitwe told Justice Richard Buteera\u00a0this afternoon that the petitioner Twaha Sanywa has not pleaded any special circumstances\u00a0including how he will suffer\u00a0a loss that cannot be compensated in damages if the 64 bn shillings is paid out to MPs.<\/p>\n
The State Attorney then asked court to\u00a0dismiss\u00a0with costs this application\u00a0for lack of merit and strong\u00a0reasons\u00a0to block government from releasing the said funds.<\/p>\n
Arinaitwe has\u00a0based her submission on an affidavit sworn by the clerk to parliament; Jane Kibirige, who says such privileges and benefits enjoyed by MPs are provided for under the law.<\/p>\n
Kibirige further argued that if court finds out at a later stage that the said money was erroneously given\u00a0 to the MPs, government can still go ahead to recover the 150 million shillings from individual MPs.<\/p>\n
However Sanywa\u2019s lawyers disagreed with her saying it’s difficult to recover\u00a0the said money from MPs since it will be withdrawn from the consolidated fund\u00a0for personal benefits without following the law governing procurement of public assets.<\/p>\n
Sanywa wants court to stop\u00a0the car purchase privilege to MPs saying it places them at a preferential treatment against other government employees in the Judiciary and Executive arms who perform their duties in public vehicles.<\/p>\n
